These Terms and Conditions (hereinafter, "T&C") govern the online purchasing service that allows the contracting of the products and/or services offered on the website www.mariayjesus.com (hereinafter "the Website").

Maria y Jesus Grupo de Compra SL is the owner of the Website and the provider of the products and/or services marketed through it.

The contractual purchase and sale relationship entails the delivery, in exchange for a price expressly determined on this Website, of a specific product or service.

Purchasing through this website implies adherence to the T&C in the version published at the time access is gained to the Website, which means that the User:

The User is responsible for the veracity of the data provided during the online purchase process. Likewise, in the event that contracting on this Website requires the registration of the User, this User has full responsibility for the use and custody of the username and password provided to them, and is responsible for the actions carried out with them.

The User must notify the provider, as soon as they become aware of it, about the loss, disclosure, or unauthorized access by a third party to their private registered User area.

Muñecas Maria y Jesus reserves the right to modify these T&C, without this affecting the products or services that were purchased through the Website prior to such modification.

All prices for products or services on the Website include VAT and any other applicable taxes. In any case, prices will be expressed in Euros (€).

The prices shown for each product or service may not include shipping, handling, packaging, shipping insurance, or any other additional service to the purchased product or service, unless expressly stated otherwise. Any such applicable additional costs will be communicated to the User before finalizing the purchase.

The prices applicable to each product or service will be those published on the Website and applied automatically by the contracting process in its final phase. The User assumes that the financial valuation of some of the products or services offered may vary in real time. In any case, this will always be communicated prior to the formalization of the purchase and sale.

The User undertakes to pay at the time of placing the order, and may pay using any of the payment methods specified on the Website.

After payment is made, the User will receive an order confirmation email, which will include a summary of the purchased items, the requested shipping method, and the destination address.

Muñecas Maria y Jesus may occasionally offer discount codes to its Users. Such discounts may only be applied according to the instructions specified by Muñecas Maria y Jesus regarding each code, and in any case, Users may only use a single code per order.

The use of discount codes will not be compatible with certain promotional actions and collections.

Muñecas Maria y Jesus will deliver the orders to the address indicated by the User in the corresponding purchase form.

Muñecas Maria y Jesus assumes no responsibility when the delivery of the orders is not carried out as a result of the data provided by the User being false, inaccurate, or incomplete, as well as for any cause attributable to the User.

Muñecas Maria y Jesus will take all necessary measures to ensure that delivery can be carried out within the agreed timeframe. Muñecas Maria y Jesus considers payment confirmation, by any of the enabled systems, a necessary condition to maintain the delivery timeframes. However, the timeframes indicated to the User are an estimate and may vary due to logistics or force majeure.

Delivery will be considered completed from the moment Muñecas Maria y Jesus or the shipping company contracted by it makes the product available to the User.

LEGAL WARRANTY OF CONFORMITY

Muñecas Maria y Jesus products are delicate handcrafted pieces, so they must be handled according to the instructions for use and conservation that accompany each product and are set out on this Website.

Muñecas Maria y Jesus is responsible for any lack of conformity existing at the time of delivery and manifesting within three years from then, in accordance with Royal Legislative Decree 1/2007, of November 16. Unless proven otherwise, it is presumed that any lack of conformity manifesting within the following two years already existed at that time.

In the event of a lack of conformity, the consumer may demand the repair or replacement of the product, a price reduction, or the termination of the contract, under the terms provided by law.

Damage resulting from use or handling contrary to the instructions, impacts, pulling, exposure to temperatures, water, or products not indicated in the instructions, nor normal wear and tear from use, do not constitute a lack of conformity.

 

EXCHANGES AND RETURNS

*The exchange and return policy only applies to those products purchased through our official Website.

In the event of a defective product, you must contact support@mariayjesus.com and send us an image clearly showing the defect, and we will try to verify that the product is indeed defective.

In the event that you have to send the product to the warehouse, Muñecas Maria y Jesus will cover the shipping costs. As soon as it is verified that the product is defective, a refund or exchange will be issued to the affected User.

In the event of receiving an order that does not correspond to what you purchased, you must contact support@mariayjesus.com within 14 days of receiving the order and send us an image showing everything you received with its respective references in the box and the proof of payment and shipping. We will provide a solution once the contents have been verified.

Muñecas Maria y Jesus will cover the shipping costs. As soon as it is verified that the order was incorrect, a refund or exchange will be issued to the affected User.

The product must not have been used and must be in its original packaging with any labels that accompanied it.

To make an exchange or return, the product must be sent back to the Muñecas Maria y Jesus offices. The timeframe for any exchange or return is 14 days from receiving the order. The product must not have been used and must be in its original packaging with any labels that accompanied it. The cost of the exchange or return will be borne by the customer.

Once the package has been returned to our offices or warehouse, it is processed before proceeding with the approval of the return. The product must be sent within 14 days of receiving the order, must not have been used, and must be in its original packaging with any labels that accompanied it

If your return is approved, a full refund of the price of the goods will be issued within 7 business days, and you will be notified of the transaction by email. Once the refund is issued, it may take 3-4 business days to become effective.

The Website provides access to Internet content belonging to Muñecas Maria y Jesus that the User may access. The User assumes responsibility for the use of the portal. This responsibility extends to the registration that may be necessary to access certain services or content. In said registration, the User will be responsible for providing truthful and lawful information.

To this end, in each personal data collection form, the User will be informed of the existence and acceptance of the specific conditions of the processing of their data, informing them of the data controller, the purpose of the processing, the legal basis, and the possibility of exercising their rights of access, rectification, erasure, objection, limitation, and portability.

Muñecas Maria y Jesus and the User agree to submit any controversy that may arise from the provision of the products or services subject to these T&C to the Courts and Tribunals of the buyer's domicile, if the User is an end consumer, or, if applicable, to the Courts and Tribunals of Madrid if the User is a company.
